In a policy memorandum dated 07/13/18, the USCIS communicated new guidance regarding the issuance of Requests for Evidence (RFEs) for petitions and applications received as of 09/11/18. The guidance allows case adjudicators to use their discretion when determining whether to issue a Request for Evidence, or to deny a case outright, if it lacks “required initial evidence” or “fails to establish eligibility”.

How will this affect case processing at FSVS? We need your help! It is more important than ever that we assemble the strongest possible evidence to demonstrate how both the USC employee and the position qualify for the visa category being requested. Please help facilitate cases by submitting Service Requests to initiate cases as soon as possible to avoid delays to desired start dates, and other case complications. Work with the employee’s direct supervisor when completing the job duties section of the case initiation packet. Detailed job descriptions that speak to the specialized nature of a position and the specific technologies/knowledge required for the role are the basis for a successful case.
